Flair Bangladesh Institute of Global Skills
These Terms and Conditions (“Agreement”) constitute a legally binding agreement between Flair Bangladesh Institute of Global Skills (“Institute,” “we,” “us,” or “our”) and any individual accessing, registering for, or using our services (“User,” “you,” or “student”).
By accessing our website, enrolling in any program, or making any payment, you expressly agree to be bound by this Agreement. If you do not agree, you must discontinue use of our services immediately.
1. Scope of Services
The Institute provides educational and professional training services, including but not limited to online and offline courses, skill development programs, workshops, certification programs and related academic or vocational training services.
We reserve the right to modify, update, discontinue, or replace any course, service, content, instructor, schedule, or pricing structure at our sole discretion without prior notice.
2. Eligibility and User Responsibility
Services are available only to individuals who are legally capable of entering into binding agreements under the laws of Bangladesh. Where users are under the age of majority, parental or guardian consent is required.
Users are responsible for ensuring that all information provided during registration, enrollment, or payment is accurate, complete and up to date. Any misuse of identity or submission of false information may result in immediate termination of access without liability to the Institute.
3. Enrollment and Access
Enrollment in any program shall be deemed confirmed only upon successful completion of payment or as otherwise approved by the Institute in writing.
Access to digital learning materials, where applicable, is granted strictly for individual use. Sharing, redistribution, reproduction, or unauthorized access of course content is strictly prohibited and may result in disciplinary or legal action.
4. Fees and Payment Terms
All applicable fees must be paid in accordance with the pricing and payment structure communicated at the time of enrollment.
Payments are processed through secure and authorized third-party payment gateways operating in Bangladesh. The Institute does not collect, store, or retain sensitive financial information such as card numbers, banking credentials, or authentication data.
The User acknowledges that all payment transactions are also subject to the terms and conditions of the respective payment service provider. The Institute shall not be responsible for delays, failures, or errors arising from payment gateway systems, banking networks, or internet connectivity issues.
5. Refund and Cancellation Policy
Fees once paid are generally non-refundable. Refunds, if any, may only be granted under specific circumstances determined at the sole discretion of the Institute, including duplicate payment or verified inability to provide the agreed service. No refund shall be applicable in cases of:
1. Change of mind after enrollment
2. Failure to attend or complete the course
3. Violation of institutional rules leading to termination
4. Partial use of services or materials
Any approved refund shall be processed through the original payment method within a reasonable timeframe, subject to payment gateway processing rules.
6. Intellectual Property Rights
All materials provided by the Institute, including but not limited to videos, lecture content, written materials, graphics, course modules, assessments, branding and logos, are the exclusive intellectual property of the Institute or its licensors.
No part of such materials may be copied, reproduced, distributed, sold, published, or transmitted in any form without prior written permission from the Institute. Any unauthorized use may result in legal action under applicable copyright and intellectual property laws of Bangladesh.
7. Code of Conduct
Users are expected to maintain professional and respectful behavior at all times. Any form of misconduct, including harassment, disruption of classes, cheating, misuse of platforms, or unauthorized recording or distribution of content, is strictly prohibited.
The Institute reserves the right to suspend or permanently terminate access to services without refund in cases of misconduct, violation of rules, or abusive behavior.
8. Certification
Certificates, where applicable, shall be issued only upon successful completion of course requirements and fulfillment of all academic and financial obligations.
Certificates issued by the Institute are intended to demonstrate participation and completion of training programs and do not constitute a guarantee of employment, income, or external accreditation unless explicitly stated.
9. Disclaimer of Warranties
The Institute provides all services on an “as is” and “as available” basis. While we strive to maintain high educational standards, we do not guarantee any specific academic, professional, or financial outcomes, including job placement, income generation, or business success.
10. Limitation of Liability
To the maximum extent permitted by law, the Institute shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use our services, including but not limited to service interruptions, data loss, technical failures, or payment processing errors.
In any case, the total liability of the Institute shall not exceed the amount actually paid by the User for the specific service in question.
11. Third-Party Services
The Institute may utilize third-party platforms and service providers, including but not limited to payment processors, communication tools and hosting services.
The Institute is not responsible for the actions, policies, availability, or performance of such third-party services.
12. Privacy and Data Protection
The Institute collects only necessary personal information required for registration, communication, academic administration and payment processing.
We do not sell or trade personal data. However, information may be shared with authorized service providers or regulatory authorities when required by law.
13. Termination
The Institute reserves the right to suspend or terminate any user’s access to services at any time, with or without notice, in cases of violation of these Terms, fraudulent activity, misuse of services, or legal necessity.
Termination shall not entitle the User to any refund except where explicitly stated under the refund policy.
14. Force Majeure
The Institute shall not be liable for failure or delay in performance of its obligations due to events beyond its reasonable control, including but not limited to natural disasters, political unrest, government actions, pandemics, internet outages, or technical failures.
15. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the People’s Republic of Bangladesh. Any disputes arising out of or in connection with this Agreement shall fall under the exclusive jurisdiction of the competent courts of Bangladesh.
16. Dispute Resolution
In the event of any dispute, the parties shall first attempt to resolve the matter amicably through mutual discussion. If resolution is not achieved, the matter shall be referred to the appropriate legal authorities or courts in Bangladesh.
17. Severability
If any provision of this Agreement is held to be invalid or unenforceable by a competent authority, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
18. Entire Agreement
This Agreement constitutes the entire understanding between the User and the Institute and supersedes all prior discussions, communications, or agreements relating to the subject matter herein.
